7.0      APPEALING A VIOLATION OF THE COVENANT DECLARATION

IMPORTANT: 

When a person is charged and on bail or being investigated for a criminal offence and a subsequent criminal offence is committed, or they violate their bail terms and conditions, there can be NO APPEAL of the Church Board’s decision.

Further, when a person violates their probation/parole order or Sex Offender Registry terms and conditions there can be NO APPEAL.  Any criminal offence will be reported to the appropriate authorities. 

For all other infractions of the Covenant:
1.      Send a suspension letter to the person involved while inquiries are ongoing.
2.      The Church Board will contact the Church lawyer to receive legal guidance.
3.      The Church Board will contact the insurance company to understand the risk indemnity and to ensure compliance with the insurance policy.
4.      The Church Board will check the bail, Probation/Parole Order, Parole Officer, and Sex Offender Registry terms and conditions to ensure they were not breached.
5.      The Church Board will check with the Pastor who is part of the spiritual guidance for the Accountability Support/Chaperone Group as to the progress of the participant.
6.      The Church Board will make inquiries as to who, what, where, when and how the infraction happened.  The Accountability Support/Chaperone Group will give the Church Board a verbal and written account of the results of their inquiries.
7.      The Church Board will make a final decision on the appeal.
8.      The Church Board will advise the Bail, Probation/Parole Order, Parole Officer, and Sex Offender Registry if any of the terms and conditions have been breached. (Appendix N)
